By accessing or using List-Master, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

List-Master is a gift list management platform that allows users to create, organize, and share wishlists. Users can add items with links to external retailers, and others can reserve items to avoid duplicate gifts.

3. User Accounts

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Upload malicious content or spam
  • Attempt to gain unauthorized access to our systems
  • Interfere with other users' use of the service
  • Scrape or harvest data from the service
  • Use automated systems to access the service without permission

5. Affiliate Links and Product URLs

Important: When you add product URLs to your gift lists, List-Master may automatically modify these links to include our affiliate tracking codes.

This means:

  • Link Modification: Product URLs from supported retailers (such as Amazon, Target, Walmart, Etsy, and others) may be replaced with affiliate versions.
  • Affiliate Compensation: List-Master may earn a commission when purchases are made through these modified links, at no additional cost to the buyer.
  • Price Unchanged: The price you pay for products is not affected by our affiliate links. You pay the same price as you would visiting the retailer directly.
  • Supporting the Service: Affiliate commissions help us maintain and improve List-Master as a free service.

By using List-Master, you acknowledge and consent to this automatic affiliate link replacement. If you prefer not to have your links modified, please do not use the service.

6. SMS/Text Message Sharing

List-Master allows you to share your gift lists via SMS text message. By using this feature, you agree to the following:

  • Consent Required: You confirm that you have permission to send text messages to the phone number you enter. You must only text people you know personally who have agreed to receive messages from you.
  • No Spam or Marketing: The SMS feature is for sharing gift lists with friends and family only. You may not use it for commercial purposes, marketing, or to contact people who have not consented to receive messages from you.
  • Your Responsibility: You are solely responsible for ensuring compliance with all applicable laws regarding text messaging, including the Telephone Consumer Protection Act (TCPA) and similar regulations. List-Master is not liable for any misuse of this feature.
  • Message Content: SMS messages sent through our service will contain your name, list title, and a link to view your gift list.
  • No Delivery Guarantee: We do not guarantee delivery of text messages. Delivery depends on the recipient's carrier and device settings.
  • Standard Rates Apply: Recipients may incur standard messaging rates from their mobile carrier.

Misuse of the SMS feature, including sending unsolicited messages, may result in immediate termination of your account.

7. User Content

You retain ownership of content you create (lists, item descriptions, etc.). By posting content, you grant List-Master a license to display and share that content as necessary to operate the service.

You are responsible for ensuring your content does not:

  • Infringe on intellectual property rights
  • Contain defamatory or harmful material
  • Violate any applicable laws

8. Third-Party Links and Services

List-Master contains links to third-party websites (retailers, product pages). We are not responsible for the content, accuracy, or practices of these external sites. Your interactions with third-party sites are governed by their terms and policies.

9. Disclaimers

List-Master is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free service
  • Accuracy of product information, prices, or availability
  • That items will be available for purchase
  • That reservations will prevent duplicate gifts

10. Limitation of Liability

To the maximum extent permitted by law, List-Master and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

11. Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. You may delete your account at any time through your account settings or by contacting us.

12. Changes to Terms

We may modify these Terms of Service at any time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or prominent notice on our website.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
